For some reason I don't understand, people treat (2) as an evolution of (1). But it is the inverse.
Presumably the point of #2 is that it's easier than the implied #3 ("The computer always drives") which is their as-of-yet unrealized goal. Of course deploying #2 into the wild may prove to be ethically unjustifiable. Being easier than the implied #3 is a poor excuse.
